Fair Dealing

In the 2004 CCH Canadian Ltd. v. Law Society of Upper Canada court ruling, The Supreme Court of Canada established 6 factors that should be taken into account when evaluating fair dealing. These factors are:

  • The purpose of the dealing
  • The character of the dealing
  • The amount of the dealing
  • Alternatives to the dealing
  • The nature of the work
  • The effect of the dealing on the work
